1. About GRUNT and These Terms
GRUNT is an iOS application provided by GET GRUNT ABN 95 151 450 531 ("we", "us", "our"), a company based in Australia. GRUNT allows tradespeople to capture voice input and generate professional quotes and invoices using artificial intelligence.
These Terms and Conditions ("Terms") govern your access to and use of the GRUNT app and any related services (collectively, the "Service"). They form a legally binding agreement between you and GET GRUNT.
These Terms apply to all users of GRUNT, including free trial users and paying subscribers. Where these Terms reference "you" or "your", this means you as an individual user and, where applicable, the business on whose behalf you are using GRUNT.
2. Eligibility
To use GRUNT you must:
Be at least 18 years of age
Have the legal capacity to enter into a binding agreement under Australian law
Be using the app for legitimate business purposes related to your trade or contracting work
Have an Apple ID and a compatible iOS device
GRUNT is intended for use by individuals and small businesses in Australia. If you are using GRUNT on behalf of a business, you represent that you have authority to bind that business to these Terms.
3. Apple App Store — Important Disclosures
This section is required by Apple and sets out the relationship between you, us, and Apple Inc. in respect of your use of GRUNT.
3.1 Acknowledgement
These Terms are between you and GET GRUNT only, and not with Apple Inc. ("Apple"). Apple is not responsible for GRUNT or its content. Apple has no obligation whatsoever to provide any maintenance or support services for GRUNT.
3.2 Scope of Licence
The licence granted to you to use GRUNT is limited to a non-transferable licence to use GRUNT on any Apple-branded products that you own or control, subject to the Usage Rules set forth in Apple's App Store Terms of Service.
3.3 Maintenance and Support
We are solely responsible for providing maintenance and support services for GRUNT, as specified in these Terms or as required by applicable law. Apple has no obligation to provide any maintenance or support services with respect to GRUNT.
3.4 Warranty
We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed under these Terms. In the event of any failure of GRUNT to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for GRUNT to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to GRUNT, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility.
3.5 Product Claims
We are responsible for addressing any claims by you or any third party relating to GRUNT or your possession and/or use of GRUNT, including but not limited to: (i) product liability claims; (ii) any claim that GRUNT fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in Australia the Australian Consumer Law.
3.6 Intellectual Property
In the event of any third-party claim that GRUNT or your possession and use of GRUNT infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.
3.7 Third-Party Beneficiary
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
4. Account Registration and Security
You may register using Sign in with Apple or an email address and password. You are responsible for:
Providing accurate and complete registration information
Maintaining the confidentiality of your login credentials
All activity that occurs under your account
Notifying us immediately of any unauthorised access to your account
We reserve the right to suspend or terminate accounts where we reasonably suspect fraudulent activity, a breach of these Terms, or non-payment of subscription fees.
5. Subscriptions, Billing, and Cancellation
5.1 Subscription Plans
Access to GRUNT's full features requires a paid subscription. Subscription plans, pricing, and included features are displayed within the app and on our App Store listing. We reserve the right to modify pricing with reasonable notice.
5.2 Free Trials
We may offer free trial periods at our discretion. At the end of a free trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends. You will be notified of the trial end date within the app.
5.3 Billing via Apple
All subscriptions are billed and managed through Apple's in-app purchase system. Your payment method on file with your Apple ID will be charged at the start of each billing period. We do not receive or store your payment card details.
5.4 Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled. Apple will charge your Apple ID account within 24 hours before the end of the current period. You can manage and cancel your subscription at any time via:
iOS Settings > [Your Name] > Subscriptions, or
The App Store > Your Account > Subscriptions
Cancellation takes effect at the end of the current billing period. You will retain access to GRUNT until that date.
5.5 Refunds
All subscription purchases are processed by Apple. Refund requests must be submitted to Apple in accordance with their refund policy. We do not process refunds directly. You can request a refund from Apple at reportaproblem.apple.com.
6. Acceptable Use
You agree to use GRUNT only for lawful business purposes. You must not:
Use GRUNT to create fraudulent, misleading, or illegal documents
Attempt to reverse engineer, decompile, or extract the source code of GRUNT
Use automated means (bots, scrapers) to access or interact with GRUNT
Resell, sublicense, or commercially distribute GRUNT or its outputs without our written consent
Upload or record audio containing offensive, illegal, or defamatory content
Attempt to circumvent any subscription or access controls
Interfere with or disrupt the operation of GRUNT or its infrastructure
We reserve the right to investigate suspected violations and to suspend or terminate access without notice where we reasonably believe a serious breach has occurred.
7. AI-Generated Content — Your Responsibility
GRUNT uses artificial intelligence to convert your voice input into quotes, invoices, and other documents. You acknowledge and agree that:
AI-generated outputs may contain errors, omissions, or inaccuracies and must be reviewed by you before use
You are solely responsible for the accuracy, completeness, and legality of any document you send to a client or submit to an accounting platform
We do not guarantee that AI-generated content will be fit for any particular purpose or comply with any specific legal or regulatory requirement
GRUNT is a productivity tool, not a substitute for professional legal, financial, or accounting advice
We strongly recommend you review every quote and invoice generated by GRUNT before sending it to a client.
8. Third-Party Integrations (Xero, MYOB)
GRUNT may integrate with third-party accounting platforms including Xero and MYOB. Your use of these integrations is subject to the terms and privacy policies of those platforms. We are not responsible for the availability, accuracy, or operation of any third-party service.
By connecting a third-party accounting platform, you authorise GRUNT to interact with that platform on your behalf in accordance with the permissions you grant. You may revoke this access at any time through the relevant platform's settings.
9. Intellectual Property
9.1 Our IP
GRUNT, including its design, code, AI models, branding, and documentation, is owned by or licensed to [YOUR COMPANY NAME]. Nothing in these Terms transfers any intellectual property rights to you. You receive only a limited, non-exclusive, non-transferable licence to use GRUNT as described in these Terms.
9.2 Your Content
You retain ownership of all content you input into GRUNT (voice recordings, business data, job descriptions, etc.) and all documents generated from that input. By using GRUNT, you grant us a limited licence to process and store your content solely for the purpose of providing the Service.
You represent that you own or have the necessary rights to all content you submit to GRUNT, and that your content does not infringe any third party's intellectual property or other rights.
10. Disclaimers and Limitation of Liability
10.1 Service Availability
We aim to provide GRUNT on a continuous basis but do not guarantee uninterrupted availability. The app may be unavailable due to maintenance, updates, or factors outside our control.
10.2 No Warranties
To the maximum extent permitted by law, GRUNT is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
10.3 Australian Consumer Law
Nothing in these Terms limits any rights you may have under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)). Our services come with statutory guarantees that cannot be excluded. Where we are entitled to limit our liability for a failure to comply with a consumer guarantee, our liability is limited to re-supplying the service or paying the cost of having the service re-supplied.
10.4 Limitation of Liability
Subject to clause 10.3, to the maximum extent permitted by law, our total liability to you for any loss or damage arising out of or in connection with GRUNT (whether in contract, tort, statute, or otherwise) is limited to the total amount you paid for GRUNT in the 12 months preceding the event giving rise to the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, even if we have been advised of the possibility of such damages.
11. Termination
You may stop using GRUNT at any time. To cancel your subscription, follow the steps in Section 5.4. Deleting the app from your device does not cancel your subscription.
We may suspend or terminate your access to GRUNT immediately if you breach these Terms, if required by law, or if we discontinue the Service. We will provide reasonable notice of discontinuation where practicable.
Upon termination, your right to use GRUNT ceases. Sections 9, 10, 12, and 13 survive termination.
12. Governing Law and Disputes
These Terms are governed by the laws of Queensland, Australia. You and we each submit to the non-exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia for the resolution of any disputes.
Before commencing legal proceedings, we encourage you to contact us directly to attempt to resolve any dispute informally. Most issues can be resolved quickly by contacting our support team.
13. General
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding GRUNT and supersede all prior agreements.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
No Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
Updates to Terms: We may update these Terms from time to time. We will notify you of material changes within the app. Your continued use of GRUNT after the effective date of updated Terms constitutes acceptance of the changes.
